CESA Guide to Mediation, Arbitration and Adjudication Nominations

Introduction

The Consulting Engineers South Africa (CESA) maintains a panel of qualified Mediators, Arbitrators, and Adjudicators to support the effective resolution of disputes, particularly within the construction and engineering sectors.

This guide provides an overview of how the CESA nomination process works and what parties can expect when requesting a nomination.

 

CESA's Role

CESA's primary role is to:

  • Maintain an up-to-date list of experienced dispute resolution practitioners.
  • Make objective and impartial nominations when requested.
  • Support fair and efficient dispute resolution processes.

CESA does not administer disputes, appoint practitioners directly, or become involved in the dispute itself.

 

How the Nomination Process Works

Option 1: Parties Select a Practitioner Directly

Parties are free to consult the CESA panel and jointly agree on a Mediator, Arbitrator, or Adjudicator of their choice.

Once selected, the parties may approach the practitioner directly to discuss availability, appointment terms, and fees.

Option 2: Request a CESA Nomination

Where parties require assistance in selecting a practitioner, CESA can provide a nomination.

When making a nomination, CESA considers factors such as:

  • Independence and absence of conflicts of interest
  • Appropriate professional experience and qualifications
  • Relevant dispute resolution expertise
  • Geographic location and accessibility
  • Suitability for the specific nature of the dispute

 

After a Nomination is Made

Once CESA has identified a suitable practitioner, the parties will be provided with:

  • The practitioner's name
  • Contact details
  • Relevant professional information (where applicable)

From that point onwards, the process becomes a matter between the parties and the nominated practitioner.

The parties are responsible for:

  • Accepting the nomination
  • Contacting the practitioner
  • Discussing availability
  • Negotiating terms of appointment
  • Agreeing on fees and administrative arrangements

 

Important Note

CESA's involvement is limited to maintaining the panel and, where requested, facilitating an impartial nomination. The appointment of a practitioner and the conduct of the dispute resolution process remain the responsibility of the parties and the appointed practitioner.
